In a significant legal challenge, attorneys for Amazon and Elon Musk’s SpaceX argued in a federal appeals court on Monday that the National Labor Relations Board (NLRB) is unconstitutional. This case, which could reshape labor law enforcement in the United States, comes as Musk is expected to play a key role in the Trump administration’s focus on reducing bureaucratic regulations.
The 5th U.S. Circuit Court of Appeals in New Orleans heard arguments in separate lawsuits filed by SpaceX and Amazon after the NLRB initiated complaints against both companies regarding labor rights and union organizing activities. A ruling in favor of the companies could significantly weaken the NLRB, which has been responsible for enforcing labor laws for nearly a century.
The panel of judges, predominantly appointed by Republican presidents, scrutinized the legal strategies employed by Amazon and SpaceX to bring their cases before the 5th Circuit. A lawyer representing the NLRB pointed out that both companies had appealed after lower courts failed to meet their deadlines for rulings.
Michael E. Kenneally, representing SpaceX, countered that the government’s focus on procedural issues highlighted the weakness of its legal position. Judge James E. Graves Jr., an appointee of former President Barack Obama, remarked on the importance of the merits of the case, suggesting that procedural arguments should not overshadow substantive legal questions.
SpaceX’s lawsuit, filed in January, stems from accusations by the NLRB that the company unlawfully terminated employees who criticized Musk in an open letter and that it created a culture of surveillance around employee activities. Among its claims, SpaceX argued that the NLRB’s proceedings violated its right to a jury trial.
Similarly, Amazon’s lawsuit relates to a union election that took place at a New York City warehouse in April 2022. The company contends that the NLRB interfered improperly in the election process, particularly by pursuing a lawsuit to reinstate a fired union organizer just before voting commenced. Although the Amazon Labor Union won the election, Amazon has not engaged in negotiations with the union.
Amazon’s legal team has argued that the structure of the NLRB is unconstitutional, asserting that board members are insulated from removal by the president, which undermines accountability. In a statement preceding the court hearing, NLRB General Counsel Jennifer Abruzzo remarked that it is common for large corporations to challenge the agency’s authority in an effort to evade accountability for labor law violations.
As the case progresses, it could ultimately reach the U.S. Supreme Court, which has shown a willingness to curtail the powers of federal agencies, particularly under a conservative majority.
This legal battle unfolds against the backdrop of Musk’s growing political influence, particularly after he contributed approximately $200 million to support Trump’s presidential campaign. Following Trump’s election, Musk was appointed to lead a new efficiency commission aimed at streamlining federal operations and reducing regulations.
