The Apple Watch is on the brink of being banned in the US.

Apple has announced that it will cease the sale of two Apple Watch models, the Series 9 and the Ultra 2, starting on December 21 online and December 23 in stores across the U.S. The decision comes after an International Trade Commission (ITC) order in October found that Apple’s oxygen sensor infringed on intellectual property owned by medical technology company Masimo.

The ITC recently denied Apple’s motion to stay the ban while the original decision is appealed, leading to the imminent halt in sales of the affected Apple Watch models. Only intervention from the White House could prevent the pause in sales, as President Joe Biden has the authority to veto the ban.

The infringement claims stem from Masimo CEO Joe Kiani, who accuses Apple of violating intellectual property and engaging in acquisition and partnership talks, only to later recruit technical staff from Masimo. Kiani stated, “I still extended the olive branch and offered to work with them for the betterment of people and our shareholders, and not even a call.”

The ban, if not overturned, would have significant implications for Apple, preventing the sale of one of its most lucrative products in the largest market, especially during the busy holiday shopping season. Retailers can continue selling Apple Watches previously imported if they have them in stock. The White House has not indicated whether President Biden will intervene to veto the ban.
