Tesla appears to be enforcing its no-resale agreement on the Cybertruck, with reports emerging of one owner being blacklisted from future vehicle purchases by the company after attempting to sell their vehicle.
The debate surrounding Tesla’s ability to enforce its Cybertruck no-resale agreement, which urges early owners to refrain from selling the limited-quantity vehicle within the first year of ownership, has garnered attention in recent months. Despite the agreement, numerous Tesla Cybertrucks have surfaced for sale online, prompting discussions on the enforceability of the no-resale clauses.
In a post on the Cybertruck Owner’s Club forum on Sunday night, a user known as malinecentral revealed that Tesla had emailed them, revoking additional Cybertruck reservations and canceling future orders after the user listed the vehicle on multiple online sales platforms.
The email from Tesla stated, “Moving forward, any future orders placed by you will be cancelled without a refund of the $100 reservation or $250 order fee as official notification has been provided to you regarding this matter.”
Although the buyer claims they haven’t completed any sales, they admitted to listing the Cybertruck on various sites to gauge interest. The user clarified that they had taken delivery of one Cybertruck and had two more reserved, but Tesla proceeded to cancel the additional reservations and issue refunds.
According to the poster, they suspect Tesla identified them through a listing on CarGurus, where they had shared the vehicle identification number (VIN) and listed the Cybertruck for $242,069. As of the time of writing, there are no matching listings on CarGurus among the 20 separate Cybertruck listings.
In its correspondence, Tesla warned of potential legal action, stating, “Tesla may seek injunctive relief to prevent the transfer of title of the Vehicle or demand liquidated damages from you in the amount of $50,000 or the value received as consideration for the sale or transfer, whichever is greater. Tesla may also refuse to sell you any future vehicles.”
As Tesla initiates early Cybertruck deliveries and ramps up production at its Gigafactory in Austin, Texas, the company anticipates reaching volume Cybertruck production within 12 to 18 months following the initial delivery event, aligning with the “limited quantity” referenced in the no-resale policy.
